It's not necessarily true he'll get in deep for it... When I did FreeiPods (when it was 20gig monochrome), I made a listing on eBay and "sold" my referral link for $20-some and even got positive feedback for it.

I used to do this for a while until eBay started pulling them and I had some people bid on my auction for 1 cent and stuff like that, but they never paid.

no, they do not have to pay. I would definately rather get a negative feedback instead of paying $80 for a ref link. He could explain how he thought it was something else and try to work it out by paying the relist fee. If the seller is an ass, he could leave negative feedback..but he will get one in return and one negative isn't the end of the world.

just to let you know, when freeipods.com was new, I did this and got over 20 greens on my ipod site, but I lost my ebay and paypal account because people were buying the auctions, even though over 10 times in each auction, in huge red letters it said "Do Not Bid On This Item, There is Nothing For Sale, You Will Receive Nothing if You Win This Auction" people were paying hundreds of dollars and sending it to my paypal, I was refunding the money when I got it but ebay and paypal still got all pissed about it... good luck with your account...

ya, you will loose your account if the auction gets over and the bidder gets pissed. you need to cancel the auction before it ends. otherwise you will be in trouble, despite if you are in the right. i've seen a good number of people loose their accounts over this stuff.

I could understand using a picture that you took that is more...artistic, but a picture of a Nano?
Same reason why gettyimages charges high prices to use their photos once. shrug
You're entitled to copyrights, and each individual is protected under the fair use law (or act, i dunno.) as long as the "work" is not used to make financial gains. Which, unfortunately, unknown uchiha is doing.

Everything on the internet is copyrighted. It doesn't necessarily mean it has to have a copright notice on it to be copyrighted.

I am quite aware that this isnt something to sue over, never suggested I would.
I have been previously asked by other people if they could use an image I had posted... I've typically always allowed them to use it. (granted this was before I obtained a dSLR). However, I probably would have still let him use the pic of my nano if he had just asked.
This has been my gripe since the very beginning. He took without asking, and then on his auction gave credit to the wrong freebie network... slightly irritating.

if i did an auction like this i'd use random proof pics too, i don't have a camera right now anyway (and lazy). it's not like this is his first freebie and hes blatently lying about receiving other stuff previously. he just made the mistake of using someones pic that someone in this thread would recognize, i mean it's a picture of a nintendo not a sunset so who cares
