Dont any of you people believe in honesty...damn people i mean the other day i found a usb memory stick at the computer lab i looked at a file and found the name of the owner i looked him up in the school directory emailed him and today i gave him his memory stick...and you know what im glad i was able to help him out i feel good about it. i hope you people do the same

I see the memory stick as a different thing than the shuffle. Gratis is right upfront that they don't have to send you anything for what you do, further, they claim that what they do send you is FREE, so one or two shuffles both are proposedly "free."

Further, given the complete lack of contractual obligation of Gratis to its users, I fail to see how there's any contractual obligation for us to send it back. Its like somebody giving you a gift and then asking for it back.

I dunno, maybe I'd feel worse about it if I hadn't had them numerous times fail to give me credit for offers, lock my account 'cause some jerk a couple levels beneath me comitted fraud, or were over a month late after saying "shipped" on my gaming system.

Blaugh. i dunno. I'll think about it. Who knows, my conscience might hit me tomorrow or something.

You don't HAVE to give back anything. It is not against the law. They can't sue you. THEY fucked up, not you. If you do send it back, do it out of the kindness of your heart, not out of fear of repercussions. They can't do anything to you. IMO, you should tell them to take you off hold and you will give them back their shuffle. FWIW.

I'm with Stroid on this one, and I also don't think it's entirely legal. Due to the lengthy provisions regarding one shipping address or household per account/product, it's pretty clear they would never intentionally ship more than one of the same product. They even state right out that no user may receive more than one product per account (section 4). Therefore, keeping a mistakenly shipped product would most probably violate the ToS.

It's also odd that folks would latch onto the "free" language, since the use of that word is merely to denote that no money is exchanged between you and the site. These things are clearly not "free" in the purest sense, since users must fulfill all of their obligations in order to be eligible in the first place. It's no different from any other contract.

I hear you Stroid! Greed that's all it is. I hope all the accounts of people who wont be honest get put on hold. I have every intention of returning my second drive when I get the necessary info from either Gratis or Efulfillment. Wouldn't you expect the same in return? What if you lost a wallet or something? Maybe they could return it to you without the money or something. Its the same principal. I can't believe all you guys.

even if gratis demands the shufles back with threat of the law being involved (wich they wont)......internet law is so flimsy and full of loopholes that nothing will ever come of it.

my opinion.......ebay them, keep them, give them as gifts, hell...do what you want with it ITS YOURS NOW
