Well i got my iPod yesterday and went to the apple store today. I exchanged it for the 40 gig b/w. Paid 74 bucks after tax using my student discount.
THANK YOU GRATIS. Worth the wait. Hopefully it will be done syncing my 3000+ library by the time i get home.
